Divorce in Alaska

There are two ways to divorce in Alaska. When divorcing spouses agree on all property division, spousal support, and child custody matters, they may sign and submit a joint petition to end the marriage. An uncontested divorce avoids a trial but takes total cooperation.

When compromise isn’t possible, the husband may file a formal divorce complaint. A contested divorce is heard in court, where a judge resolves any disputes.

Family Law Center for Men® is a dedicated litigation firm focused on complex contested legal issues. We prepare every case as if it were heading directly to a full trial. Our attorneys are prepared to present a powerful case before a judge.

Defending Your Property and Assets

When divorcing spouses cannot agree, the court will divide and distribute marital property fairly, but that doesn’t require a 50-50 split. The court examines several factors to reach a just outcome.

Judges consider the couple’s lifestyle, the length of the marriage, and the earning capacity, education, and employment opportunities of each spouse. The financial condition of each family member after the divorce is also considered, along with any history of unreasonable spending or abuse of shared marital assets.

Personal property includes property owned before the marriage or received through personal inheritances and gifts. Property acquired or earned in a marriage, including real estate and retirement accounts, is joint marital property. If it is commingled with joint assets, personal property can become marital property.

An Anchorage family law attorney at Family Law Center for Men® can work to prevent the court from awarding unfair financial compensation to your spouse at the expense of your future financial stability.

Custody Rights

Alaska establishes two categories of child custody. Physical custody determines daily living arrangements and the parenting schedule. Legal custody gives a father the right to make decisions about a child’s healthcare, education, and religious practices. When making custody decisions, an Alaska court focuses entirely on a child’s best interests. Judges consider:

  1. the child’s physical, emotional, mental, and social needs
  2. the desire and capability of each parent to meet those needs
  3. the length of time the children have lived in a stable environment
  4. any history of domestic violence, child neglect, or abuse in the household

Alaska courts generally prefer joint legal custody, but arrangements for physical custody can vary. A parent who has the kids for more than 70 percent of the year holds primary physical custody. Shared physical custody applies if the children spend at least thirty percent of the year (110 or more nights) with each parent.

Our legal advocacy is unyielding. We stand up for fathers who want an active, meaningful role in their children’s lives. Family Law Center for Men® can help you prepare a parenting plan that demonstrates your commitment, stability, and capability to the judge.

Calculating and Adjusting Alaska Child Support Obligations

A child support obligation in Alaska is determined by a formula that accounts for parental income and the court-ordered physical custody arrangement. For primary custody arrangements, noncustodial parents pay a set percentage of their adjusted annual net income based on the number of children.

Calculations are more complicated when parents share physical custody. The court calculates the obligations for both parties, tracks the parenting time percentages, and offsets the amounts.

Standard percentages do not automatically apply to the portion of a parent’s adjusted annual income that exceeds $138,000. For high earners, any additional support awards require specific justification based on the children’s actual needs.

An Anchorage family lawyer at Family Law Center for Men® can scrutinize financial disclosures to ensure the court has accurate data. If your financial situation changes due to a job loss or an income shift, we can seek a modification to align your support obligation with your financial condition.

Domestic Violence Allegations and Protective Orders

Domestic violence allegations can destroy your reputation and your custody rights. Under Alaska law, a single finding of domestic abuse creates a powerful statutory presumption against awarding custody to that parent. It is exceptionally difficult for an accused father to win joint or sole custody.

The Boney Courthouse in downtown Anchorage handles domestic violence restraining orders. Your spouse can obtain a temporary, ex parte protective order without you even being present in the courtroom. Once an order is issued, you may be forced out of your own home and blocked from seeing your kids before you get to explain your side of the story.

Family Law Center for Men® provides aggressive defense representation for men facing false or exaggerated abuse allegations. We know these claims are sometimes used as tactical weapons in a divorce or custody battle. We gather evidence, cross-examine accusers, and present the truth to clear your name and protect your rights.

If you are a man experiencing abuse or harassment from a family member, we can take immediate action to secure your safety. We listen without judgment and provide the strong legal protection you need to secure your home and your peace of mind.

Representation for Military Personnel

Anchorage is home to the military community centered around Joint Base Elmendorf-Richardson. For military personnel, family law involves a layer of complex federal regulations in addition to Alaska state law. A military divorce requires a family lawyer who understands military leave and earnings statements and housing allowances.

Under the Servicemembers Civil Relief Act, active-duty members may pause Alaska court proceedings when stationed or deployed abroad, so your spouse cannot win a default judgment against you while you serve your country.

Custody plans must include clear provisions for potential deployments, temporary duty assignments, and out-of-state relocations. Dividing military retirement benefits is a high-stakes matter governed by the Uniformed Services Former Spouses’ Protection Act.

The court can divide a military pension as marital property, but specific federal rules dictate how these benefits are calculated and paid. The attorneys at Family Law Center for Men® know how to protect your benefits, your career, and your retirement.

An Aggressive Law Firm Is Essential for Your Case

When your assets and your relationship with your children are on the line, passive mediation can lead to unfair results. If the opposing party refuses to be reasonable, a compromising approach will not protect your interests.

Family Law Center for Men® is a dedicated litigation firm. We do not hide from courtroom conflict; we welcome it. Our trial-tested lawyers prepare every case for the courtroom from day one. Thorough preparation gives us a distinct advantage by showing the opposition that we are prepared to fight before a judge.
